Access to, and use of Dorismond products (“Products”), Dorismond services (“Services”), and the Dorismond website https://www.dorismond.com/ (“Website”), including any of its content, is conditional on your agreement to these terms. You must read, agree with, and accept all of the terms and conditions contained in these terms. You agree not to use the website or services for any illegal or prohibited purpose as defined in this clause. You agree not to use the website or services in any way that could harm Dorismond's website, services, products or general business. You also agree not to use the website or its services: To harass, abuse, or threaten others, or to violate anyone's legal rights in any other way; To infringe on Dorismond's or a third party's intellectual property rights; Uploading or otherwise disseminating computer viruses or other software that may cause damage to another's property; Engage in or create any illegal gambling, sweepstakes, or pyramid scheme; Publish or distribute any obscene or defamatory material;  Publish or distribute any material that incites violence, hatred, or discrimination against any group; Illegally gather information about others.

Account: By creating an account, or by using or visiting our website, you are bound to these terms and you indicate your continued acceptance of these terms. Your Dorismond account if you create an account on the website, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You agree to provide and maintain accurate, current, and complete information, including your contact information for notices and other communications from us and your payment information. You may not use false or misleading information in connection to your account, or trade on the name or reputation of others, and Dorismond may change or remove any information that it considers inappropriate or unlawful, or otherwise likely to expose Dorismond to claims of third parties. You agree that we may take steps to verify the accuracy of the information you have provided to us. You are responsible for taking reasonable steps to maintain the confidentiality of your username and password. You are responsible for maintaining the safety and security of your account information. You must immediately notify Dorismond at hello@dorismond.com of any unauthorized uses of your information, your account, or any other security breaches. Dorismond will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Customer Charged at Checkout: At the time of booking, the customer's payment method will be charged in accordance with the photographer or videographer's posted rates on the Dorismond system for the type and length of the session that the customers have requested, plus any applicable taxes. If the customer chooses one of our third-party offers to facilitate installment payments, they completely accept all of the terms and conditions of that offer, including your agreement to pay the total amount of installments to the lender or its assignee.

Relocations: The session's location and time may be altered up to 24 hours in advance, provided that Dorismond and the customer agree to the move. The Dorismond team will use the service, if authorized, to update the location.

Reschedules: Customers may change their session time up to 24 hours in advance by getting in touch with our customer support staff or the individual assigned to the scheduled date directly and arranging a new time and date that works for everyone. Time up to 24 hours in advance, the customer may try to arrange a new date and/or location for the session if a weather-related catastrophe or other uncontrollable event prevents it from going as planned between the customer and Dorismond, if they are unable to come to an agreement, the customer is eligible for a refund of any fees paid for the session. Customer is permitted to reschedule in less than 24 hours with a 5% session charge with Dorismond's approval.

Cancellation: Customers may cancel free of charge if a new date cannot be found and the request is made at least 24 hours before the session. Customers who cancel with less than 24 hours' notice, however, will be charged a 10% cancellation fee and won't get a full refund from Dorismond.

Extended hour: All customers understand that they will be required to pay the entire cost of the extended hour if more time is required. Customers agree that in order to recover the additional time expended working on the project, Dorismond may authenticate and process payments using the debit or credit card on file.

No-Shows: In the event that a customer fails to show up for a reservation, the customer is not eligible for a refund of any fees paid for the session.

Delivery of Images: The photographer is required to upload the images to the client's photo gallery within eight (8) to twenty (20) hours following the session. Following the customer's selection of their preferred photos for processing, Dorismond will confirm delivery depending on the predetermined delivery time for the scheduled shoot type.

Video delivery: Depending on the booked shoot type's set delivery time, Dorismond will confirm the final delivery.

Image Rights: The rights of customer to use images from a photoshoot shall be as determined or subject to the following terms: no rights are granted to customers unless payment has been made by the customer; additionally, the customer grants Dorismond the right to use the photographs for marketing purposes if necessary. If customer’s payments for a photoshoot are subject to chargebacks, the licenses granted to customer for those images automatically terminates when the chargeback occurs.

Video Rights: The customer's rights to utilize videos from a session must comply with the rules outlined below. No rights are granted to customers prior to receipt of payment from the customer, and the client also gives Dorismond permission to use the videos for marketing if necessary. The licenses for the films given to the customer immediately expire when a chargeback is made on the customer's purchases for a session. 

Indemnification: You agree to indemnify and hold Dorismond, its employees, and affiliates harmless from any claims, damages, losses, liabilities, and expenses arising from your use of our Services or any violation of these Terms. 

Limitation of Liability: To the extent permitted by law, Dorismond shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use our Services.

Dorismond reserves the right to modify this agreement at any time and without notice to you. You agree that Dorismond has the right to modify or revise this agreement at any time. If any part or sub-part of this agreement is deemed ineffective or invalid by a court of law, you agree that the previous, effective version of this agreement will be considered enforceable and valid to the fullest extent possible. You agree that your continued use of the website following any changes to this agreement constitutes your continued acceptance of this agreement. Dorismond reserves the right to terminate this agreement with you at any time, with or without cause.

You warrant that you have read and reviewed this agreement and agree to be bound by it by using the website.
